Feet On The Train

The state Supreme Court of New York made it clear in March of this year that not only is taking pictures on the trains and subways legal, but photographers have a right to take photos, especially if they are doing it for publication in a recognized magazine or web site since it falls nder freedom of the press.

Nevertheless, I am frequenlly stopped and have even been arrested, simply for taking pictures in public of women's feet.  Needless to say, the charges have been dropped and were brought to harass and force me to spend money for a lawyer which has only served to force me to seek legal remedies of my own to protect my right to photograph women's feet in public.

I would be interested in the experience of others in this regard and how you have handled it. Remember, no one has a right to search your camera contents w/o a search warrant and to get a warrant, they must have probable cause that a crime is being commited.  Taking photos in public of women's feet is NOT a crime so long as you do not follow, touch, annoy, etc., etc.

Now to my story.  I have always loved to watch women's feet and shoes on the train and subway. My favorites are women who dangle and play with their shoes or massage and touch their own feet, especially if they know I am looking.  I make no attempt to hide the camera, though many are not aware I am photographing their feet.
 

One gal, you see here, when she realized I was looking at her feet and taking pictures, began to slip her shoe off and on and massage and tickle her own feet.  She was a little older than most of the women I photograph, but her feet were great. Since my station was next in a few minutes, I thought it safe to ask if her feet were bothering her as I had noticed her massaging and ticklng them.

She said, "Oh I've had a long day and can't wait to get home and take my shoes off."

I then asked if she was aware I was photographing her feet.

She replied, "At first no, but as I began playing with my shoe, I watched your reaction and you seemed to really get turned on."

I told her she was driving me crazy, but would never do anything and I seldom say anything to anyone because I don't want to harass. She said that it was okay, and that she once had a boyfriend with a foot fetish, so she understood. By then my stop had arrived, I told her to have a nice day, and left.

I have to say that women are often aware that I am taking pictures of their feet, and I often ask permission. Most agree without a problem since I try to be super nice, and some have even gotten aroused at the act of me taking pictures of their feet.

The whole idea is to have fun and not upset anyone.
